Article 1. Purpose of the Terms of Service

These terms of service ("ToS") define the rules for using the mobile application "Bodyra" (the "Application"), published by Star 48, whose registered office is at Bâtiment Mykonos, 137 Avenue de la Lanterne, 06200 Nice, France ("Star 48", "we", "us").

By installing the Application on your device and/or accessing it, you fully accept these ToS without reservation and agree to comply with all obligations outlined herein. If you do not agree to these ToS, please do not use the Application.

These ToS constitute the entire agreement between you and Star 48 regarding your use of the Application. Star 48 reserves the right to modify these ToS at any time by updating them. The applicable version is the one in effect at the time of your connection and use of the Application. Where a change is significant, we will inform you within the Application. We recommend you regularly check this page.

Article 2. Purpose and features of the Application

The Application is a training tool. It allows you to:

• Answer an onboarding questionnaire about yourself and your training goals (gender, age, height, weight, target weight, primary goal, experience level, training days, available equipment, obstacles, focus areas, units).
• Photograph yourself from the front and from the back, so that an automated visual analysis can produce a scan.
• Receive, for each scan, a score from 1 to 5 for seven muscle regions, a front-to-back balance indicator, a left-right symmetry indicator, and an estimate of your body composition.
• Receive a multi-week workout plan generated automatically from those results and from your questionnaire answers.
• Follow, complete or skip your training sessions, record a reason for skipping, rate a session from 1 to 5 and add a written comment.
• Re-scan yourself approximately every three weeks, after which your plan is rebuilt using the new results.

These features may be enriched, changed or removed at any time by Star 48 without incurring liability, in particular to improve the service or to reflect changes in the technologies we rely on.

Article 3. Access to the Application and account creation

To access the Application you need a compatible Apple iPhone and an Internet connection. The Application is distributed through the Apple App Store.

Creating an account is required. Sign-in is handled by Firebase Authentication using Sign in with Apple or Sign in with Google. We receive your email address, your display name and a user identifier. We never receive or store your Apple or Google password.

You agree to provide true, accurate and complete information, and to update it promptly if it changes. Your answers to the questionnaire and your body measurements directly determine the plan you receive: inaccurate information will produce an inappropriate plan.

You are solely responsible for keeping access to your account secure. If you become aware of unauthorised use of your account, you must notify us immediately at stephane@star48.io.

One account is for one person. You may not create an account for someone else, share your account, or let another person be assessed through your account.

Article 4. The Application is not a medical device and does not provide medical advice

This is the most important article of these ToS. Please read it in full.

Bodyra is not a medical device. It is not certified, approved or registered as one, and it is not intended to diagnose, treat, cure, monitor or prevent any disease, injury or medical condition.

Assessments are automated estimates. Your photographs are analysed automatically by software, including a third-party artificial intelligence model (Google's Gemini API). The muscle scores, balance and symmetry indicators, and body-composition estimate are produced by that automated analysis. They are estimates based on the appearance of two photographs. They are not measurements, they are not clinical evaluations, and they can be wrong.

Results vary with conditions. Lighting, posture, camera angle, distance, clothing, hydration, time of day and image quality can all change your results from one scan to the next, even when your body has not changed. Differences between two scans should be read as a rough indication of a trend, never as a precise measurement of progress.

No professional relationship. Using the Application does not create a doctor-patient, physiotherapist-patient, dietitian-client or personal-trainer-client relationship between you and Star 48. Star 48 does not review your results individually and does not supervise your training.

Never rely on Bodyra for a health decision. Do not use the Application to detect, confirm or rule out any health problem, and do not delay or disregard advice from a qualified health professional because of anything you have seen in the Application. If you notice a change in your body that concerns you, consult a doctor. In an emergency, contact your local emergency services immediately.

The workout plan is generic. Plans are produced by an automatic algorithm from the information available to it. They are not adapted to any injury, illness, disability, pregnancy, medication, allergy or individual limitation that the Application does not know about, and no human being reviews your plan before you receive it.

Article 5. Your responsibility to train safely

Physical exercise carries an inherent risk of injury, and in rare cases of serious harm. You use the Application, and follow any plan it generates, at your own risk and under your own responsibility.

Consult a professional first. You should consult a doctor before starting, resuming or significantly changing a training programme, and in particular if you have or have had a heart condition, high blood pressure, a musculoskeletal injury, a chronic illness, an eating disorder, if you are pregnant or have recently given birth, if you are taking medication, or if you are over 40 and have been inactive. If a doctor, physiotherapist or qualified coach advises you differently from the Application, follow the professional, not the Application.

Train within your limits. You are responsible for judging whether an exercise, a weight or a session is appropriate for you. Warm up properly, use correct technique, choose loads you can control, use safety equipment where relevant, and make sure your training environment is safe.

Stop if something is wrong. Stop training immediately and seek medical attention if you feel pain, dizziness, faintness, shortness of breath, chest discomfort or any other worrying symptom.

Nutrition and weight goals. Any target weight or body-composition figure shown in the Application is a number you supplied or an automated estimate. It is not a health recommendation and must not be treated as a target set by a health professional. If you have or suspect you have a disordered relationship with food, exercise or body image, please seek professional support before using the Application.

You accept that Star 48 cannot observe your form, your environment or your physical state, and therefore cannot and does not guarantee that any exercise or plan is safe or suitable for you.

Article 6. Acceptable use

Minimum age. You must be at least 16 years old to use the Application, and onboarding does not accept an age below 16. The Application is not intended for children. If we learn that an account belongs to a person under 16, we will delete it and the data attached to it.

Only photograph yourself. You may upload photographs of your own body only. You must not upload a photograph of any other person, whether or not they consent, and you must never upload a photograph of a minor. Uploading an image of a minor in any state of undress is a serious criminal offence and will be treated as such: we will terminate the account and report it to the competent authorities.

Photographs must be appropriate to the purpose. Photographs must be of your body, taken for the purpose of an assessment, front and back. You must not upload sexual, obscene, violent, hateful or otherwise unlawful content, images that do not depict a body, or images intended to mislead or test the automated analysis.

You further agree not to:

• Use the Application for any unlawful purpose, or in breach of these ToS.
• Present the Application's results as a medical, clinical or professional assessment, whether of yourself or of anyone else.
• Resell, redistribute or commercially exploit the results, plans or content produced by the Application.
• Access, attempt to access, copy, decompile or reverse-engineer the source or object code of the Application, or its underlying models and prompts.
• Use robots, scripts, scrapers or any automated means to access the Application, extract data from it, or send it content.
• Attempt to disrupt, overload, damage or circumvent the security of the Application or of the servers and services it relies on.
• Attempt to identify, re-identify or obtain information about any other user.

Star 48 may suspend or terminate your access, without prior notice and at its sole discretion, if you breach this article or any other provision of these ToS.

Article 7. License of use

Star 48 grants you a personal right to use the Application and its content. This right is non-exclusive, revocable, non-transferable and worldwide, strictly for the personal use of the Application and no other purpose.

You do not acquire any intellectual property rights over the Application or its content other than those granted under these ToS. This licence ends automatically when your account is deleted or your access is terminated.

Your content. You keep all rights in the photographs you upload and the information you enter. You grant Star 48 only the limited right to host, transmit, process and analyse that content for the purpose of providing the service to you: producing your assessments, generating your plans, and auditing the quality of the automated analysis. We do not sell your content, and we do not use it for advertising. How that content is handled, stored and deleted is described in our Privacy Policy.

Article 8. Bodyra Pro subscription

Some features of the Application require a paid subscription called "Bodyra Pro", offered on a weekly or yearly basis. Subscriptions are auto-renewable.

The sale is made by Apple. Bodyra Pro is sold through the Apple App Store and is subject to Apple's Media Services Terms and Conditions in addition to these ToS. Payment is taken by Apple and charged to your Apple ID account at confirmation of purchase. Star 48 never sees, receives or stores your card details. We use the service RevenueCat solely to know whether your subscription is active and which plan you hold.

Prices. The applicable price and billing period are those displayed in the Application at the time of purchase, in your local currency, including applicable taxes. If a price changes, Apple will notify you and, where required, ask for your consent; the new price applies from the next renewal.

Automatic renewal. Your subscription renews automatically for the same period, at the then-current price, unless you cancel it at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours preceding the end of the current period.

How to cancel. You can cancel at any time from your Apple account: open the Settings app on your device, tap your name, then Subscriptions, select Bodyra and choose to cancel. Cancellation takes effect at the end of the period already paid for; you keep access to Bodyra Pro until then. Star 48 cannot cancel a subscription on your behalf.

Deleting the app does not cancel anything. Uninstalling the Application, or deleting your Bodyra account, does not stop billing. You must cancel through your Apple account as described above.

Free trials and introductory offers. Where a free trial or introductory offer is made available, it converts into a paid subscription at the end of the trial period unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial.

Refunds and withdrawal. Because Apple is the seller, all refund and withdrawal requests are handled by Apple in accordance with its own terms, through your Apple account or Apple's support pages. Star 48 cannot issue refunds for purchases made through the App Store. You may still contact us at stephane@star48.io if you have a problem, and we will help where we can.

Article 9. Personal data

Bodyra processes personal data, including data that is sensitive by nature: photographs of your body, and body measurements and estimates derived from them. How we collect, use, share, store and delete that data is described in full in our Privacy Policy, which forms part of your agreement with us.

In summary, and so that nothing in these ToS surprises you:

• Your photographs are uploaded to Firebase Storage (Google Cloud). EXIF metadata, including any location information, is stripped on our servers before analysis.
• Your photographs are sent to Google's Gemini API for the automated assessment. The results are stored, and the raw model responses are retained so that we can audit the quality of the analysis.
• Your scores and plans are stored in MongoDB Atlas, and our API runs on Google Cloud Run in the us-central1 region. This means your data, including your body photographs, is transferred to and processed in the United States.
• Photographs are served through short-lived signed links rather than public URLs.
• The Application offers a setting not to keep scan photographs, in which case they are deleted once the assessment is complete, and a setting to blur faces. You can delete an individual scan or all of your scans at any time.
• Deleting your account removes your database records, your stored photographs and your authentication account. It does not cancel your subscription (see Article 8).

We use the following service providers to operate Bodyra: Google Firebase, Google Gemini, Google Cloud Run, MongoDB Atlas, RevenueCat, Sentry and Apple. We use no advertising networks and we do not sell personal data.

You may exercise your rights of access, rectification, deletion, objection and portability by writing to stephane@star48.io.

Article 10. Intellectual property

All content in the Application is subject to French, EU and international copyright and intellectual property laws. All reproduction and representation rights are reserved by Star 48, including graphic, iconographic and photographic representations, as well as the structure of the Application, its texts, its scoring method and the algorithm that generates the workout plans.

Reproducing and/or representing any trade names, trademarks, logos, domain names or other distinctive signs of Star 48 is strictly prohibited and constitutes infringement under the French Intellectual Property Code. The word "BODYRA" and the associated logos are the property of Star 48.

This article does not apply to your own content, which remains yours as set out in Article 7.

Article 11. Availability of the Application

The Application is intended to be available 24/7. However, due to the complexity of the Internet, network conditions, high traffic at certain times and the third-party services on which the Application depends, Star 48 offers no guarantee of uninterrupted service and cannot be held liable for temporary inaccessibility, slowness or the temporary unavailability of the automated assessment. No compensation is granted under this provision.

Maintenance, updates and changes to the third-party services we rely on may interrupt access without notice. Star 48 reserves the right to discontinue, without notice or liability, and at its sole discretion, the provision of all or part of the Application or its features, either temporarily or permanently. If we permanently discontinue a paid feature, you may cancel your subscription through Apple as described in Article 8.

Article 12. Limitation of liability and absence of warranty

Star 48 will make every effort to provide the best possible access to the Application and to keep the automated assessment working as intended. Our obligation is one of means, not of result.

The Application, the assessments and the plans are provided "as is", without warranty of accuracy, completeness, reliability or fitness for any particular purpose. Star 48 does not warrant that the muscle scores, balance and symmetry indicators or body-composition estimates are correct, nor that any plan will produce a given result, a given physique or a given change in weight or body composition.

You acknowledge and accept that your use of the Application, the information you provide, the photographs you upload and the decisions you take on the basis of your results are your sole responsibility.

To the fullest extent permitted by law, Star 48 cannot be held liable for any indirect damage, loss of data, loss of opportunity or economic loss resulting from the use or unavailability of the Application, nor for any injury, harm or health consequence arising from physical exercise you undertake, from following a plan generated by the Application, or from relying on an automated assessment contrary to Articles 4 and 5.

Nothing in these ToS excludes or limits liability that cannot be excluded or limited under French law, in particular in the event of fraud, gross negligence, or death or personal injury caused by our fault. If you are a consumer, your mandatory statutory rights are unaffected by this article.

Article 13. Suspension, termination and account deletion

You may stop using the Application at any time and delete your account from the Application's settings, or by writing to stephane@star48.io. Deletion removes your database records, your stored photographs and your authentication account, and it is irreversible. Remember that it does not cancel a subscription bought from Apple.

Star 48 may suspend or terminate your access, without prior notice and at its sole discretion, in the event of a breach of these ToS, in particular a breach of Article 6, or where required by law.

Termination does not entitle you to a refund of amounts already paid, except where required by law or granted by Apple.

Article 14. No waiver and severability

Failure by either party to enforce any provision of these ToS shall not constitute a waiver of that provision.

If any provision of these ToS is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

Article 15. Applicable law and disputes

These ToS are governed by French law. Any dispute concerning the Application or the interpretation of these ToS will be submitted to the competent court in France.

If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of that country.
